General terms & conditions

of Ötztaler Verkehrsgesellschaft mbH (T&C)

English translation – non-binding. This English version is provided for convenience only. In case of any discrepancy, the German original (AGB) prevails as the legally binding version.

1. Travel contract

1.1

These general terms and conditions govern transfers carried out by Ötztaler Verkehrsgesellschaft mbH, Ötztal Straße 2, 6450 Sölden (hotline +43 (0) 5254 / 3550) from the respective airport into the Ötztal valley (Haiming, Sautens, Oetz, Umhausen, Längenfeld, Sölden, Obergurgl).

1.2

Transfer bookings become binding upon order and credit card payment. Side agreements that do not match the transfer order require express approval by Ötztaler Verkehrsgesellschaft mbH.

1.3

Ötztaler Verkehrsgesellschaft mbH is a traditional bus and rental car company, serving guests in the Ötztal for decades.

1.4

The conditions of the travel agency trade also apply.

2. Payment

2.1

Payment is made exclusively online by credit card (Mastercard, Visa) via the Ötztaler website and is binding. The payment confirmation including booking number is the shuttle ticket from the airport to the specified drop-off point in the Ötztal or vice versa.

2.2

Acceptance of these T&C creates a legally binding contract.

2.3

Current prices for the listed transfers are published on www.oetztaler.at and apply per person unless stated otherwise. The child fare applies exclusively to children up to and including the age of 14 (age at the time of the journey).

2.4

If the number of passengers or the age of children was incorrectly stated at booking, Ötztaler Verkehrsgesellschaft mbH is entitled to charge the additional fare directly during the journey. If payment of the surcharge is refused, we reserve the right to exclude passengers from the journey.

3. Transfer

3.1

Transport is conditional on presentation of the booking confirmation with its booking number. Transfer can be refused if the booking confirmation is not presented. Customers are responsible for carrying the necessary travel documents.

3.2

Transfers depart from the agreed meeting point, which must be precisely defined. Customers must wait at the agreed meeting point at the stated time. If the customer is not present, the transfer departs. No refund will be made in this case.

3.3

Departure must be booked so that, under normal conditions, the transfer reaches Innsbruck Airport on time. Travel time can be up to 3 hours (guideline). Particularly on Saturdays and public holidays, longer transfer times are to be expected due to traffic. The customer must take this into account when booking.

3.4

Arrival must be booked so that, under normal conditions including baggage claim (approx. 30 minutes), the customer reaches the meeting point on time.

4. Changes, rebookings, cancellations

4.1

Green Line Package: bookable up to 48 hours before departure. Green Line Flex: bookable up to 48 hours before departure; additional bookings up to 1 hour before departure. Exclusive and Limousine Service: bookable up to 48 hours before departure. Rebookings involving children are only possible up to 24 hours before departure for safety reasons (child seats).

4.2

Unused transfers are forfeited without refund of the transfer fee. No further claims may be made.

4.3

If the transfer is significantly hindered, endangered or impossible due to reasons outside our control (avalanches, mudslides, etc.), Ötztaler Verkehrsgesellschaft mbH may cancel the transfer. The transfer fee will be refunded. No further claims may be made.

4.4

Ötztaler Verkehrsgesellschaft mbH is entitled to cancel a transfer if the passenger endangers the transfer or other passengers through their actions or omissions. In this case the transfer fee will be refunded. No further claims may be made.

4.5

Ötztaler Verkehrsgesellschaft mbH reserves the right to make minor changes to the transfer, provided no significant changes to transfer times occur.

4.6

If the transfer is cancelled up to 2 working days before departure, the cancellation fee is 20%. If cancelled within 2 working days before departure, the cancellation fee is 100%. No further claims may be made.

4.7

In case of flight delays the customer must inform our hotline promptly so that any rebooking can be arranged. Without timely notification there is no further claim to a transfer.

4.8

If delays occur due to traffic jams, accidents, road or airport congestion or diversions, particularly on Saturdays, Ötztaler Verkehrsgesellschaft mbH is not liable for missing flights. Such delays must be considered when booking.

4.9

We aim to bring customers directly, without detours, to the booked stop. If for organisational or weather-related reasons the stop cannot be served directly, we will provide direct transfer to the stop. Changing vehicles may therefore occur. There are no additional costs and no entitlement to a refund.

5. Insurance

5.1

Travel cancellation insurance, which we recommend, is not included in the transfer price.

6. Luggage

6.1

The driver takes all necessary safety measures for a safe journey, including how the journey is conducted and especially the loading and unloading of luggage.

6.2

Customers are responsible for ensuring their luggage is loaded into and unloaded from the vehicle. Luggage is generally transported in the same vehicle. If this is not possible, luggage will be delivered to the passenger's hotel in one of the following transfers within 6 hours (provided a label with the hotel name is attached). No reimbursement of expenses will be made.

6.3

If luggage is not packed in a manner suitable for travel, the driver may refuse transport.

6.4

Ötztaler Verkehrsgesellschaft mbH accepts no liability for damage to luggage caused by other luggage.

7. Transport of children and infirm persons

7.1

Pursuant to passenger transport law, all persons (0 to 99 years) must be transported in their own seat. This is charged normally. Required child seats must be specified at booking.

7.2

If there is a risk during transfer that the passenger may pose a danger to themselves or others due to physical or mental condition, no liability is assumed for personal injury up to and including death.

8. Refusal of transport

Ötztaler Verkehrsgesellschaft mbH may refuse transport if one or more of the following applies:

  • Transport would endanger the safety or health of other passengers or the driver, or constitute an unreasonable burden.
  • The mental or physical condition of the passenger, particularly due to alcohol or drugs, poses a risk to the passenger themselves, other passengers or the driver.
  • The passenger cannot present a booking confirmation or booking number.

9. Duty to cooperate

9.1

Customers are obliged to inform the local driver immediately of any complaints. The driver will arrange a remedy where possible. If the customer fails to report a defect, no entitlement to reduction arises.

10. Handling of complaints, exclusion periods, statute of limitations

10.1

If a defect cannot be fully or partially remedied, a written record must be made together with the driver. Claims for non-contractual performance must be asserted against Ötztaler Verkehrsgesellschaft mbH in writing.

10.2

Claims for non-contractual performance lapse 6 months after the contractually agreed transfer.

11. Data protection

11.1

Personal data such as name, address, credit card details are essential for booking. The data provided is processed, stored and forwarded electronically within the scope of the contract. Personal data is protected in accordance with the Federal Data Protection Act.

12. Liability

12.1

Ötztaler Verkehrsgesellschaft mbH accepts no liability for indirect or consequential damages unless caused by gross negligence or wilful intent. In no case will the amount of proven damage be exceeded.

12.2

Where international agreements or related regulations provide for liability limitations for service providers of Ötztaler Verkehrsgesellschaft mbH, we may invoke them in the event of a claim.

13. Place of jurisdiction

13.1

The place of jurisdiction for actions against Ötztaler Verkehrsgesellschaft mbH is Silz, Austria.

14. Other provisions

14.1

These conditions apply unless individual agreements are made.

14.2

The above provisions only apply if statutory provisions taking effect after printing do not provide otherwise.

14.3

The invalidity of individual provisions does not result in the invalidity of the entire contract.
